Sequoia Atlantic Trading Company

These Terms and Conditions (“Terms”) govern the use of this website and all business activities coordinated by Sequoia Atlantic Trading Company, a Delaware-based entity (“Sequoia Atlantic,” “we,” “our,” or “us”), acting as the holding company for Sequoia Distribution, which serves as the licensed exporter of record for federally legal hemp-derived products under U.S. law.
By accessing this website or engaging our export services, you agree to these Terms.
1. Role and Scope of Services
Sequoia Distribution, a subsidiary of Sequoia Atlantic Trading Company, acts as the exporter of record for all outbound shipments. Sequoia Atlantic Trading Company serves as the corporate holder and oversight entity, coordinating legal, strategic, and intercompany operations across its subsidiaries.
Sequoia Distribution’s responsibilities include:
- Export classification and documentation under 15 CFR and CBP rules;
- Coordination with licensed U.S. producers;
- Filing export declarations and ensuring outbound compliance;
- Interface with U.S. Customs and Border Protection (CBP) as the official exporter of record.
Sequoia Atlantic does not itself hold or move product, but oversees compliance, documentation accuracy, and commercial structuring at the group level.
2. Legal Classification of Goods
Sequoia Distribution only exports goods that:
- Are represented as hemp under 7 U.S.C. § 1639o, not marijuana;
- Contain ≤ 0.3% delta-9 THC on a dry weight basis;
- Are supported by third-party Certificates of Analysis (COAs);
- Are classified under HTS Code 5302.10.0000 (true hemp, raw or processed, not spun).
We reserve the right to reject or suspend any shipment that appears to fall outside this scope.
3. Intended Use Disclaimer
Products exported by Sequoia Distribution are:
- Intended solely for industrial, aromatic, or botanical use;
- Not intended for combustion, inhalation, ingestion, or pharmaceutical preparation;
- Labeled and documented accordingly.
Buyers and importers agree not to promote, repurpose, or repackage these products for unauthorized uses in any jurisdiction.
4. Export & Import Responsibilities
Sequoia Distribution is responsible for:
- Accurate export documentation;
- Compliance with U.S. export laws (including 15 CFR and CBP rulings);
- Filing export declarations as required.
The importer of record (consignee or Morland Atlantic Trading Company LTD) is solely responsible for:
- Legal importation under local law;
- Tariffs, excise, VAT, and product registration;
- Providing all required import permits or customs broker information.
5. Producer Licensing and Verification
Sequoia Distribution only coordinates exports from licensed U.S. hemp producers. We require and maintain:
- State or USDA license verification;
- Current COAs from DEA-registered or ISO-accredited labs;
- Chain-of-custody documentation.
We reserve the right to disclose producer documentation to authorities upon request.
6. Anti-Diversion Policy
Sequoia enforces strict anti-diversion controls. All parties agree:
- Not to misrepresent the intended use, destination, or classification of exported goods;
- Not to divert shipments to unauthorized jurisdictions;
- To comply with all local, national, and international laws.
Violations may result in blacklisting, legal action, and notification to U.S. and foreign authorities.
7. Limitation of Liability
Sequoia acts as exporter of record only through its subsidiary, Sequoia Distribution. We disclaim all liability for:
- Import seizures, delays, or regulatory reclassification; based on product or COA’s
- Product performance or fitness for use;
- Unlawful handling by third parties post-export.
Our liability is limited to the amount of service fees paid directly to us.
8. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California. All disputes shall be resolved via:
1. Good faith negotiation, and if unresolved;
2. Binding arbitration in Beverly Hills, CA
9. Amendments
We may amend these Terms without prior notice. Your continued use of our services constitutes acceptance of any changes.
